A separate legal framework, a separate alert genre

The 18 cases in this chapter are a small but distinct corner of the archive. Missing-student notifications are governed by the Higher Education Opportunity Act of 2008 (HEOA), not by the Clery Act, and the legal framework is meaningfully different. Under HEOA's missing-student provisions, residential institutions must (1) maintain a missing-student notification policy, (2) give every student living on campus the opportunity to identify a confidential contact who will be notified if they are reported missing, (3) notify that contact within 24 hours of the missing-person determination, and (4) for students under 18 who are not emancipated, notify the parent or guardian regardless of whether a confidential contact has been identified.

That legal scaffolding shapes the alerts. A missing-student notification is sent only after the institution has determined the person is in fact missing, a determination that typically requires that 24 hours have passed since the last verifiable contact, that the person has not made expected appearances at class or work, and that the institution's residential life staff have attempted to reach them through normal channels and failed. The alert that goes out to the campus community, when it goes out at all, is therefore a different document from a Clery emergency notification: it is older, more deliberate, and more carefully composed.

The genre's standard structure

A missing-student campus alert in this archive almost always contains five elements: the name of the missing person, a physical description, the date and location of the last confirmed sighting, the clothing description from that sighting, and a phone number for the campus police or the local police agency taking the lead on the investigation. The verbatim text varies remarkably little across institutions because the genre is closer to a law-enforcement BOLO ("be on the lookout") than to a campus-emergency message. The cases here document that template across roughly a decade of practice.

What varies between institutions is the channel: some send the missing-student notification via SMS to the entire campus community, others send it only to the residential population, others restrict it to faculty and staff, and a few send it only to the student's college or department. The Department of Education has not issued definitive guidance on which of these is required; the case-by-case institutional judgment is preserved here.

The cases that defined the genre

The most-cited missing-student case in American higher education is Lauren Spierer at Indiana University, June 3, 2011, a 20-year-old sophomore who left an off-campus bar at approximately 4:30 AM and was never seen again. The institutional response in the days following her disappearance (the messages sent to the campus community, the way the university coordinated with Bloomington Police and the FBI, the way the residential community was kept informed) became a template that other institutions have studied and emulated. The case file in this chapter preserves the verbatim text of those communications.

Other documented cases include Hannah Graham at the University of Virginia, September 13, 2014 (a second-year student last seen in Charlottesville's Downtown Mall, the case that led to the conviction of Jesse Matthew for her murder and for the 2009 murder of Morgan Harrington), Mickey Shunick at the University of Louisiana at Lafayette, May 19, 2012, Maura Murray at UMass Amherst, February 9, 2004, and Caleb Harris at Texas A&M University-Corpus Christi, March 4, 2024. Each of these produced not just a missing-student notification but a multi-week sequence of follow-up communications as the search continued, and several of them, most notably the Graham case, produced an emergency-notification-style alert when the institution learned the student had been killed and the suspect was still at large.

Where missing-person merges with timely warning

A subset of the cases here are not pure HEOA missing-student notifications. They are cases where the missing student was eventually determined to have been a victim of foul play, and the institution then had to send a Clery-required timely warning about the suspect or about the broader threat to the community. The transition from one alert genre to the other, from "we are looking for a missing student" to "we are looking for the suspect who killed our student," is one of the most rhetorically difficult writing tasks documented in the entire archive. The institutions in this chapter that handled it well did so by keeping the two messages separate in time and structure: the missing-student message stays on its own track even after the case becomes a homicide investigation, and the timely warning is issued as a separate, parallel communication.

What this chapter teaches

Three patterns:

  1. Slow alerts are not bad alerts. Missing-student notifications are some of the slowest in the archive, typically 24 to 48 hours after the last confirmed sighting. The slowness is not a failure mode; it is a feature of the genre's legal framework, which requires the institution to confirm the person is actually missing before issuing the notification.

  2. The confidential contact is a non-public part of the genre. Most of what HEOA requires happens before any public message is sent: the call to the confidential contact, the call to the parent. The campus-wide alert is the third or fourth thing the institution does, not the first. The case files in this chapter document the public-facing alerts; the private notifications that preceded them are not preserved here because they are not public records.

  3. The genre converges with timely warnings only when the case becomes a crime. When a missing-student case is resolved by the student being found safe, the alert sequence ends quietly. When the case becomes a homicide investigation, the institutional voice changes registers and the case migrates into the interpersonal-violence chapter's writing conventions. The cases here that made that transition, most notably Hannah Graham, are flagged in their annotations.

This is the smallest chapter in the archive. It is also one of the most carefully composed, because the genre is forgiving of slowness in a way that no other category is.
